      <title>Waterford Short Sale Realtor Tip #20, Whose Turn is it to Call the Bank?, Bloomfield Hills, Michigan! Mike Sher </title>
      <description>&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;I was talking to a Birmingham Short Sale Seller who happened to be listed with another Realtor (no one is perfect :) ).&amp;nbsp; The Seller happened to have read my blog and was calling me for advice.&amp;nbsp; His/her agent, a well known and accomplished local Realtor, was not as proficient in Short Sale negotiations as the seller thought they would be. &amp;nbsp;The Seller became aware of this after signing a six month listing agreement.&amp;nbsp;&amp;nbsp;&amp;nbsp;The problem was the listing Realtor was barley communicating to the bank at all with an offer that was 2 months old and getting older.&amp;nbsp; The seller had picked up the slack and was calling the bank in hopes to get the Short Sale through.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In theory the Seller calling the bank is a good idea, especially if the listing agent is with out a team and lacks the people power needed to get a short sale through.&lt;/p&gt;
&lt;p&gt;I have a team of people who in conjunction with my efforts are all calling the bank.&amp;nbsp; But the difference between The Mike Realtor Team calling the bank instead of the Seller is:&lt;/p&gt;
&lt;p&gt;1.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We log our calls, I know exactly: what the last team member did;&lt;/p&gt;
&lt;p&gt;a.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; What number they called?&lt;/p&gt;
&lt;p&gt;b.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Who they called, name, extension, ID#, Dept...&lt;/p&gt;
&lt;p&gt;c.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; What was said, so we can quote them later...&lt;/p&gt;
&lt;p&gt;d.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; When was it said, date, time?&lt;/p&gt;
&lt;p&gt;e.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; What does the time line look like?&lt;/p&gt;
&lt;p&gt;f.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; What is the next action for this file?&lt;/p&gt;
&lt;p&gt;g.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Do we have a negotiator?&lt;/p&gt;
&lt;p&gt;h.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; What is his/her name?&lt;/p&gt;
&lt;p&gt;i.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; How can I reach them?&lt;/p&gt;
&lt;p&gt;j.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Has a BPO been completed?&lt;/p&gt;
&lt;p&gt;2.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; If the seller talks to the bank, they could be pressured into a commitment that they would like to avoid.&lt;/p&gt;
&lt;p&gt;a.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Since we our not principals of the Short Sale, we are able to avoid;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; i.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;The banks efforts to pressure or threaten the seller.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;ii.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; Give the Seller the opportunity of time&amp;nbsp;to consider all of the bank requests.&lt;/p&gt;
&lt;p&gt;3.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; The Mike Realtor Team does this for a living;&lt;/p&gt;
&lt;p&gt;a.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We never get angry.&lt;/p&gt;
&lt;p&gt;b.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We never get frustrated.&lt;/p&gt;
&lt;p&gt;c.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We know the right questions to ask.&lt;/p&gt;
&lt;p&gt;d.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We know when we are getting the run around.&lt;/p&gt;
&lt;p&gt;e.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; We keep our Eye on the Ball and focus on the closing!!&lt;/p&gt;
&lt;p&gt;f.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; And we are aware of all aspects of the Real Estate Transaction.&lt;/p&gt;

&lt;li&gt;On your addendum's to your purchase agreement include &quot;buyer agrees to supply listing agent first 5 digits of buyer's social security number, address, phone number and date of birth 24 hours after mutual acceptance of&amp;nbsp;offer.&quot;&lt;/li&gt;
&lt;li&gt;After starting the short sale on equator (make sure you seller is available) &amp;nbsp;3 way call &amp;nbsp;866.880.1232 to set up the borrower on Equator&lt;/li&gt;
&lt;li&gt;PDF in advance, into individual files, the borrowers tax returns, last two pay stubs, bank statement, hardship letter, financial statement, w2's and etc.&lt;/li&gt;
&lt;li&gt;Check Equator daily to see if you have any open tasks, complete them ASAP!&lt;/li&gt;
&lt;li&gt;Email through equator 24 to 48 hours after you have completed a task.&lt;/li&gt;
&lt;li&gt;Call equator weekly if your account has been idle on the BOA side, have the customer service person trigger the account.&lt;/li&gt;
&lt;li&gt;upload bank statements and pay stubs when every your seller gets them.&lt;/li&gt;
&lt;li&gt;if you lose the buyer, be prepared to start over again and not to lose your cool!!!&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;Realtors have told us the better they understand the counter offer process, the more successful they are in closing short sales.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;The following facts related to the counter offer process are critical to closing short sales in Equator.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;act #1: Your acceptance of the counter offer terms does not mean the transaction is approved&lt;/strong&gt;Acceptance of the counter offer means that Bank of America will take the next step of presenting the transaction for approval to the investor. &amp;nbsp;In some short sales, multiple approvals may be necessary from others including the second lien holder, mortgage insurer and Bank of America senior management.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Fact #2: The terms of the accepted counter offer may be approved, declined or changed &lt;/strong&gt;Any of the parties reviewing the transaction can change the terms of the transaction, approve or decline it.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Fact #3: The counter offer may have an expiration date&lt;/strong&gt;Please reply to the counter offer before the expiration date. &amp;nbsp;If you don't reply by the expiration date the transaction will be rejected and you must restart the process by initiating the short sale and resubmitting documents.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Fact #4: The counter offer must be accepted via the offers management tool in Equator &lt;/strong&gt;To accept the counter offer, go to the &quot;Workflow&quot; section of Equator and select the &quot;Offers Needs Response&quot; link. &amp;nbsp;Select &quot;Counter Offer&quot; and press the &quot;Accept&quot; button in the Counter Offer screen. &amp;nbsp;You &lt;strong&gt;&lt;span&gt;cannot&lt;/span&gt;&lt;/strong&gt; accept a counter offer via an Equator email to your negotiator.&lt;/p&gt;

&lt;p&gt;&lt;a href=&quot;https://www.efanniemae.com/sf/guides/ssg/annltrs/pdf/2010/svc1007.pdf&quot;&gt;Fannie Mae&lt;/a&gt; and &lt;a href=&quot;http://www.freddiemac.com/sell/guide/bulletins/pdf/bll1012.pdf&quot;&gt;Freddie Mac&lt;/a&gt;both issued new guidelines to servicers Tuesday, which allow homeowners with GSE loans to pursue a short sale or deed-in-lieu of foreclosure if they are unable to secure a modification under the government's foreclosure prevention program.&lt;/p&gt;
&lt;p&gt;When the Treasury's Home Affordable Foreclosure Alternatives (HAFA) program &lt;a href=&quot;http://www.dsnews.com/articles/hafa-is-officially-underway-2010-04-05&quot;&gt;rolled out in early April&lt;/a&gt;, officials explained that the GSEs' loans were not eligible - an interesting omission considering Fannie and Freddie are operating under full government control and have been positioned as the support columns of the administration's response to the housing crisis.&lt;/p&gt;
&lt;p&gt;The GSEs' exclusion from HAFA was puzzling to a number of industry experts and a common query posed by our DSNews.com readers. In response, Treasury officials said then that they were anticipating Fannie and Freddie to launch their own short sale-friendly programs - and those announcements came Tuesday.&lt;/p&gt;
&lt;p&gt;Both Fannie Mae and Freddie Mac encouraged servicers to begin implementing their HAFA procedures &quot;immediately.&quot; By August 1, 2010, all Fannie Mae and&lt;/p&gt;
&lt;p&gt;Freddie Mac servicers must have incorporated HAFA into their operations and begin offering HAFA solutions to eligible borrowers. The program is effective through December 31, 2012.&lt;/p&gt;
&lt;p&gt;Like the original HAFA guidelines issued from Treasury, Fannie and Freddie loans must first be found eligible for the Home Affordable Modification Program (HAMP). If the borrower then fails to fulfill their HAMP obligations, a HAFA short sale or deed-in-lieu will be offered, but unlike the non-GSE HAFA program, Fannie and Freddie stipulate that HAFA can be applied &lt;em&gt;only&lt;/em&gt; after &quot;all other home retention workout options have been exhausted.&quot;&lt;/p&gt;

&lt;p&gt;The GSEs will pay financial incentives to both servicers and borrowers who make use of a short sale or a deed-in-lieu to avoid a foreclosure on a HAMP-eligible loan. Servicers will receive $2,200 for every HAFA short sale and $1,500 for every HAFA deed-in-lieu completed. Borrowers are entitled to an incentive payment of $3,000 to assist with relocation expenses.&lt;/p&gt;
&lt;p&gt;The Treasury recently raised its HAFA payouts. For both short sales and deeds-in-lieu completed on non-GSE loans, servicers get $1,500, and $3,000 goes to the borrower.&lt;/p&gt;
